UNUM LTC rating and class action

What has happened to UNUM rating for LTC since the recent Nov-2002 class action suit regarding payments being declined to NY policy holders?? Would you buy a new UNUM LTC policy now or wait for the smoke to clear or go to a different LTC provider for indemnity type policy.
